RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION, MEDIA RELEASE, VIRTUAL SERVICES AGREEMENT, AND REFUND & CANCELLATION POLICY

READ CAREFULLY – THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS

This Agreement is entered into by Coach Chris Cobb LLC DBA Top Prospects Goaltending USA ("TPG"), and the undersigned participant and/or parent/legal guardian.

By registering for, purchasing, or participating in any TPG Service, I agree to be legally bound by this Agreement in full.

1. DEFINITIONS AND BUSINESS INFORMATION

TPG includes Coach Chris Cobb LLC DBA Top Prospects Goaltending USA, its owners, coaches, employees, contractors, volunteers, agents, affiliates, and facility partners.

TPG Services include all camps, clinics, lessons, training sessions, dryland training, gym training, classroom instruction, transportation services, and virtual or remote coaching services.

Participant includes any individual enrolled in or participating in TPG Services.

PART I – ASSUMPTION OF RISK & RELEASE OF LIABILITY

2. GENERAL ASSUMPTION OF RISK

I understand that participation in ice hockey, goaltending, and athletic training involves inherent and unavoidable risks.

These risks include, but are not limited to:

-Pucks, sticks, skates, nets, and training equipment

-Collisions with players, coaches, or objects

-Falls on ice or training surfaces

-Ice and facility conditions

-Physical exertion, fatigue, and overuse injuries

-Equipment failure or improper use

-Transportation-related risks

-Environmental and facility hazards

These risks may result in serious injury, permanent disability, concussion, paralysis, or death.

3. GOALTENDING-SPECIFIC RISKS (HEAD & BODY IMPACT)

I understand that goaltending involves repeated exposure to high-speed shots and deflections directed toward the body and head.

I acknowledge:

Shots may strike the head, face, or neck

Concussions and head injuries are inherent risks of goaltending

These risks exist even with proper instruction and protective equipment

These risks cannot be fully eliminated

I voluntarily assume all risks associated with participation in goaltending.

4. NO GUARANTEE OF SAFETY

I acknowledge that no coaching instruction, supervision, or protective equipment eliminates all risk of injury.

5. EQUIPMENT RESPONSIBILITY

I am responsible for ensuring all personal equipment is properly fitted, maintained, and safe. TPG is not responsible for personal equipment.

6. FACILITIES AND PREMISES LIABILITY

I acknowledge that injuries may occur anywhere on or around facilities used for TPG Services, including but not limited to:

-Ice rinks

-Gyms and training facilities

-Dryland training areas

-Locker rooms

-Hallways and common areas

-Parking lots

Surrounding property - I voluntarily assume all risks associated with participation in activities conducted at these locations.

7. RELEASE OF LIABILITY

To the fullest extent permitted by law, I release, waive, and discharge TPG from any and all claims arising from participation in TPG Services, including claims alleging negligence.

8. INDEMNIFICATION

I agree to indemnify and hold harmless TPG from any claims, damages, liabilities, or expenses, including attorney's fees, arising from participation in TPG Services.

9. TRANSPORTATION LIABILITY WAIVER

I understand that TPG may provide or arrange transportation between facilities, including but not limited to Elev802 Las Vegas and Indoor 5 Soccer. Transportation may be provided by staff-operated vehicles, company vehicles, rental vehicles, or third-party transportation providers. I voluntarily assume all transportation-related risks and release TPG from liability arising from transportation services provided or arranged through TPG.

10. MEDICAL AUTHORIZATION

In the event of injury or medical emergency, I authorize TPG to obtain emergency medical treatment for myself or my minor child.

I accept full financial responsibility for all medical treatment provided.

11. COMMUNICABLE DISEASES

I voluntarily assume all risks associated with exposure to communicable diseases, viruses, bacteria, or other infectious illnesses.

12. PERSONAL PROPERTY

TPG is not responsible for lost, stolen, or damaged personal property.

13. MEDIA RELEASE

I grant TPG permission to photograph, record, and use images or video of participants for marketing, promotional, educational, and social media purposes, including facility livestreaming.

PART II – VIRTUAL MENTORSHIP SERVICES

14. VIRTUAL MENTORSHIP

I understand TPG provides virtual coaching services, including:

-Video analysis

-Messaging feedback

-Remote training guidance

-Zoom consultations

-Educational content

I acknowledge that:

These services are advisory and instructional in nature

I perform all physical training independently

Injury risk remains my responsibility

All liability protections and releases contained in this Agreement apply to virtual coaching services.

PART III – REFUND & CANCELLATION POLICY

15. CAMPS, CLINICS, AND GROUP PROGRAMS

All camp and clinic registrations are final at the time of purchase.

All camp and clinic payments are 100% non-refundable and non-transferable under all circumstances, including but not limited to:

-Illness or injury

-Scheduling conflicts

-Voluntary withdrawal

-Late arrival or early departure

-Missed days

-Removal from participation for behavioral or safety reasons

-Partial attendance

-No refunds, credits, make-up sessions, or rescheduling options are provided for camps or clinics.

16. PRIVATE LESSONS

All lessons are non-refundable once purchased.

Lesson Cancellation & Rescheduling

All private and semi-private lessons require a minimum of 36 hours' notice for cancellation or rescheduling.

Cancellations made with less than 36 hours' notice will be charged in full

No-shows will be charged in full

Rescheduling is subject to availability

Lesson Credits:

If a lesson is canceled with at least 36 hours' notice:

-The lesson may be rescheduled

-The lesson value may be applied as a future lesson credit

Lesson credits:

-Has no cash value

-Are non-refundable

-Are non-transferable unless approved in writing by TPG

Lesson Credit Expiration:

Lesson credits expire 90 days from the original scheduled lesson date unless otherwise approved in writing by TPG.

Unused credits expire automatically and are forfeited without refund.

17. VIRTUAL MENTORSHIP SERVICES

All virtual mentorship, video analysis, programming, messaging support, and remote coaching services are non-refundable once purchased. No credits, refunds, or partial reimbursements will be issued for unused services.

18. SCHEDULE CHANGES

TPG reserves the right to modify schedules, locations, facilities, coaches, or programming due to operational, safety, weather, or facility-related circumstances.

No refunds will be provided due to such changes.

19. GOVERNING LAW

This Agreement shall be governed exclusively by the laws of the State of Nevada.

20. SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

21. ELECTRONIC ACCEPTANCE

By registering for, purchasing, accessing, or participating in any TPG Service, I acknowledge that I have read, understood, and agree to be bound by this Agreement.

I further acknowledge that checking an acceptance box, completing a registration form, submitting payment, electronically signing a waiver, or otherwise participating in any TPG Service constitutes my electronic signature and agreement to all terms contained herein.

If the participant is under eighteen (18) years of age, the parent or legal guardian represents and warrants that they have the legal authority to enter into this Agreement on behalf of the minor participant and agree to all terms and conditions contained herein.
